Terms of Service

1. Who may use Mnemoir (18+ only)

The Service is available only to people who are 18 years of age or older. By registering you represent and warrant that you are at least 18. We do not knowingly provide the Service to minors.

If you misrepresent your age, you bear the legal consequences of that misrepresentation, and we may suspend or terminate your account immediately without refund. If the Service detects signals suggesting an account is used by a minor (for example self-described age or school-life context in conversations), we may interrupt the conversation, surface help resources, review the account and, where warranted, terminate it and delete its data.

2. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate registration information and keep it up to date. One account is for one person; do not share or transfer accounts.

3. Your content and your clones

Mnemoir lets you create AI “clones” from material you provide (descriptions, conversations, chat exports, voice recordings). You retain ownership of the content you provide. You grant us a limited license to store and process that content solely to operate and improve the Service for you (including extracting and storing long-term memories that personalize your clones).

If you create a clone of, or upload the voice of, a living person other than yourself, you are solely responsible for obtaining that person's consent and for all consequences of failing to do so. The following are prohibited and may result in removal and account termination:

• Clones of deceased celebrities or public figures.
• Clones of political figures.
• Using a clone or cloned voice to impersonate a real person for deception, fraud or harassment.

4. Acceptable use

You agree not to use the Service to:

• Generate or solicit sexually explicit content. Mnemoir permits warm and romantic companionship, but it is not an adult-content service.
• Engage in any illegal activity, or generate content that is defamatory, hateful or that infringes others' rights.
• Harass, threaten or harm any person, or attempt to extract personal data about others.
• Probe, overload or disrupt the Service, or attempt to access other users' data.
• Resell, scrape or systematically extract the Service or its outputs without our written permission.

5. AI-generated content

All clone replies are generated by artificial intelligence. They may be inaccurate, incomplete or fabricated, and they are not statements by us or by any real person. They are not medical, legal, financial or psychological advice. See the Disclaimer, which is part of these Terms, for details.

6. Subscriptions, credits and payments

Paid features are billed through Stripe. We do not store your card details.

• Subscription credits are granted each billing cycle and reset at the end of the cycle; unused subscription credits do not roll over.
• One-time top-up credits do not expire.
• Credits are a prepaid measure of Service usage. They have no cash value and are non-transferable.
• You can cancel a subscription at any time through the billing portal; cancellation takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable; we may issue refunds or credit at our discretion. Prices may change with notice before your next billing cycle.

7. Termination

You may stop using the Service or request account deletion at any time. We may suspend or terminate your account if you violate these Terms (including age misrepresentation and the prohibitions in Sections 3 and 4), or if required by law. Upon termination your data is handled as described in the Privacy Policy.

8. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free or that AI outputs will be accurate or fit for any particular purpose.

To the maximum extent permitted by applicable law, our total liability for all claims arising out of or relating to the Service is limited to the amounts you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special or consequential damages, including emotional distress arising from reliance on AI-generated content.

9. Changes to these Terms

We may update these Terms from time to time. For material changes we will ask you to review and accept the updated Terms the next time you use the Service. Continued use after acceptance constitutes agreement to the updated Terms.
